But it doesn't parse properly unless you're Yoda. think it's an example of surface taking precedence over accurate wordplay. As it reads, the Observer should be embracing right and it isn't.

I think 8D is ok because of the comma. I didn't think of the Latin words though so I couldn't parse it until reading this thread.

As it first appears, you are correct, but if punctuation is added thus, it works :
observer; (embracing right, that is)

"Ignore the punctuation and add your own if necessary" is fairly standard in cryptic crosswords, although pay attention to ? and !

As always, mental repunctuation of a clue is the key to its solution.

Not a bad rule of thumb.
