I too had only 38 cells initially and I'm a bit uncertain about the slight adjustment I made to make it 39.

I have a full grid, but I don't know how as I cannot spot 13 of the misprints, and some that I have are very suspicious. Time to shelve this for a while and return refreshed.

A real howler, as already noted. Unusual for this to get past both the setter's proofreader and the editor(s) - I've always assumed that there's avery stringent copy-editing regime for the Listener, as such lapses are extremely rare - I can't remember another such.
Fortunately in this case the error is obvious, and doesn't compromise the solve.

I'm now down to two missing misprints, those in 24 & 25 across. I'm 99% positive that I know what they are but just cannot see them!

24a - the altered word makes up the last 4 letters of the answer

25a - It defines letters 3,4 and 5 and is a Scots version of a word that can mean 'take a chance'?

Surely 22a should be sparrow, not swallow?

Much grid-staring still hasn't found the fourth thematic requirement. Three of them have obvious cruciverbal interpretations, but - unless the wiki list is incomplete - no fourth capable of such interpretation leaps (or even crawls) out. (I'm looking for something with 6 letters, or perhaps more if it crosses something I already have.) If a hint is possible without giving too much away it would be received with gratitude.

Cockle, the first page of the Wiki entry was comprehensive enough for me...

Cockie, I'm 7 letters short (i.e. 32 highlighted), and those I have are numbers 3,4 & 6 in chronological order.

Or 6 letters short if I replace no. 6 with no. 10.
