Interesting question.
There are various schools of thought on capital letters. Using one where it isn’t necessary in order to deceive is perhaps ok, though it will raise eyebrows. Of course it’s much better to use the word at the beginning of the clue so as to be ambiguous. What should be avoided is removing a capital where the sense in the clue requires one. Making Harry into harry, for example, when it needs to be read as the person for the clue to work, or using a lowercase “nice” to indicate the place in France.
There are no rules of course, but I think these conventions are generally followed.
