Just finished, but I can't parse my last two:

5d Business incurs penalty (restricting legislation) (8)
I have Practice as the answer, but only because it fits my crossers - no idea about the parsing.

16d Very quarrelsome whip, Dan upset Harry (3-3-3)
Cat and dog seems to be the only possible answer, but apart from the middle word being an anagram of Dan, I can't see the rest of it. What has Harry got to do with anything?

5 Price is the 'penalty', Act is the legislation inside (restricting)

16 Cat = whio, And = anagram (upset) of Dan and Dog = harry, harass, hound etc.

Having trouble parsing 23a "Flourishing, with new leader giving way (8)". Answer seems to be "yielding" but I can't think of a word for flourishing given by changing the first letter...?

Got it - wielding. I knew as soon as I posted the penny would drop :-)
