This has to be 'leading question' but why?
And if not, then what?

'Leading questions' aren't allowed in court, in examinations, cross-examinations etc.

I think that is the answer.
Not allowed in court and adding “mustn’t it?” to a statement is (by example) a mean’s of doing just that.

I've managed to finish this delightful puzzle in (for me) record time, but I can't parse 7d.
"Born in penury and delivering pure rough diamonds (15)."
I think the answer is 'underprivileged' but I can't parse it.
