hecuba - it's 37 - 38
Take L from Lover and add to pLan.

The 'cap' is the first 3 letters of a famous Indian mausoleum (reversed it's a native of NW India).

Anagram of first letters for 'plan'.

Sorry, it took me far too long to type that!
I'll leave it to orson now he's back on line.

39ac Seem to have gone wrong, because there's no word to fit.

I have _O_A_I_O

Could you tell me where I've gone wrong please?

I have m for the last letter for 39a.

Def = migrants' condition

The e from 38 is added to 'on'

So 'I' goes into no + word for deranged + abbreviation for a particular kink

Thanks so much, hecuba.

For 39d I had a synonym, which also fit the altered definition. It's a very tricky IQ this week.

I'm also struggling to find 3d which I have ending PS. Have I gone wrong there too?
(Admittedly, for 12a I found a very obscure word for controlling a boat, which i though could mean rows.)

jazzlover - it looks like you have a problem with the top corner. For 8ac the whole clue reads normally as the definition, and the last three words make up the wordplay with 't' removed - 'no(t) taking bend' (it is 'speed' in the slang sense in the def).
12ac is a common word for things that deceive. remove the 'first p(o)int' [North] from a 5 letter synonym for 'rows'.

Thanks so much ddxx.

I had taken N out, giving not taking bed i.e. up after runner with speed - i.e. fit - for fit up. Know it's a 2 word phrase, but the way words are being chopped and combined in the clueing, didn't hesitate to enter it as I usually would.

...for 3dn you're looking for an '(a)ID request' - lose the end from a 4 letter hyphenated synonym for 'fair'.
